SE Career College of Health Sexual Violence Policy - January 1, 2024

1. Sexual Violence Policy

(a) SE Career College of Health is committed to providing its students with an educational environment free from sexual violence and treating its students who report incidents of sexual violence with dignity and respect.

(b) SE Career College of Health has adopted this Sexual Violence Policy, which defines sexual violence and outlines its training, reporting, investigative, and disciplinary responses to complaints of sexual violence made by its students that have occurred on its campus, or at one of its events and involve its students.

(c) The person accused of engaging in sexual violence will be referred to as the “Respondent” and the person making the allegation as the “Complainant.”

2. Definition of Sexual Violence

Sexual violence means any sexual act or act targeting a person’s sexuality, gender identity or gender expression, whether the act is physical or psychological in nature, that is committed, threatened, or attempted against a person without the person’s consent. This includes sexual assault, sexual harassment, stalking, indecent exposure, voyeurism, and sexual exploitation.

3. Training, Reporting, and Responding to Sexual Violence

(a) SE Career College of Health shall include a copy of the Sexual Violence Policy in every contract made between it and its students, and provide a copy to career college management, instructors, staff, employees, and contractors while training them about the policy and its processes.

(b) The Sexual Violence Policy shall be published on its website or, where there is no website, in a conspicuous location on each campus.

(c) Career college management, instructors, staff, employees, and contractors will report incidents or complaints to the Campus Administrator upon becoming aware of them.

(d) Students affected by sexual violence or needing support services should contact the Campus Administrator.

(e) SE Career College of Health will attempt to keep all personal information confidential, except when an individual is at imminent risk of harm or where the safety of others is at risk. Complaints and information will be accessible only to those involved in the investigation or implementation of safety measures.

(f) Students who report incidents in good faith will not face disciplinary action for violations of policies relating to drug or alcohol use at the time of the alleged incident.

(g) Students disclosing sexual violence will not be asked irrelevant questions during the investigation process.

(h) Complainants have the right not to report or participate in an investigation, though SE Career College of Health may be required to act if safety concerns exist.

(i) The college will accommodate students affected by sexual violence and provide access to counseling and support services, as outlined in Appendix 1.

4. Investigating Reports of Sexual Violence

(a) Any student may file a written report or complaint to the Campus Administrator. The Director of Education Services will also be involved.

(b) Upon receiving a report or complaint, the Campus Administrator will:

(i) Determine whether an investigation should proceed and if the Complainant wishes to participate.

(ii) Decide who will conduct the investigation based on the seriousness of the allegation.

(iii) Determine whether the incident should be referred to the police.

(iv) Implement interim measures, if necessary.

(c) During the investigation, the college will:

(i) Allow both parties to have someone present during the investigation.

(ii) Interview the Complainant and gather detailed information.

(iii) Inform and interview the Respondent, providing details of the allegations.

(iv) Interview witnesses and other relevant individuals.

(v) Provide updates to both parties.

(vi) Review evidence and determine outcomes, including disciplinary actions.

5. Disciplinary Measures

(a) Disciplinary actions may include termination of employment, expulsion, or other appropriate measures based on the circumstances.

6. Appeal

(a) Complainants or Respondents may appeal decisions within 3 days by submitting a letter to the Director of Education Services.

7. Making False Statements

(a) Knowingly making false complaints or providing false information is a violation of the policy and subject to disciplinary action.

8. Reprisal

(a) Retaliation or threats against those involved in the complaint process are prohibited and subject to disciplinary action.

9. Review

(a) Student input will be considered during reviews or amendments to the policy.

(b) The policy will be reviewed every 3 years, with the next review scheduled for December 6, 2027.

10. Collection of Student Data

(a) SE Career College of Health will collect and provide student data upon request as required by the Ontario Career Colleges Act, 2005.
